Welcome to Afroduca! By accessing or using the Afroduca classified ads platform (the "Service"), provided byBenok IT Consult Ltd ("Afroduca," "we," "us," or "our"), you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By accessing or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to all of these Terms, then you may not access or use the Service.
2. Description of Service
Afroduca is an online platform that allows users to post and view classified advertisements for various goods, services, and opportunities. We provide a venue for users to connect and transact directly with each other. Afroduca is not involved in the actual transactions between users.
3. User Accounts
3.1. Account Creation: To post advertisements or access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2. Account Responsibility: You are solely responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.
3.3. Account Suspension/Termination: We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.
4. User Conduct and Content Guidelines
4.1. Prohibited Content: You agree not to post, upload, or transmit any content that: * Is illegal, fraudulent, misleading, deceptive, or unethical. * Infringes upon the intellectual property rights of others (e.g., copyright, trademarks). * Is defamatory, libelous, slanderous, harassing, abusive, threatening, or discriminatory. * Is obscene, pornographic, or sexually suggestive. * Promotes violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic. * Contains viruses, malware, or any other harmful code. * Constitutes spam, chain letters, pyramid schemes, or unauthorized advertising. * Violates any applicable local, national, or international laws and regulations, including those related to advertising, sale of goods, and provision of services in Ghana.
4.2. Responsibility for Content: You are solely responsible for all content that you post, upload, or otherwise make available through the Service. You represent and warrant that you have all necessary rights to such content and that it does not violate these Terms or the rights of any third party.
4.3. Monitoring and Removal of Content: While we do not generally pre-screen user content, we reserve the right to monitor, review, edit, or remove any content at our sole discretion, without notice, for any reason, including if we believe it violates these Terms.
4.4. Interactions with Other Users: You are solely responsible for your interactions with other users of the Service. We are not responsible for the conduct of any user and disclaim any liability in connection therewith. Exercise caution and good judgment when communicating with other users and engaging in transactions.
5. Transactions and Disclaimer
5.1. Direct Transactions: Afroduca provides a platform for users to connect. All transactions, agreements, and interactions between users are solely between them. We are not a party to these transactions and have no control over the quality, safety, legality, or accuracy of the items or services advertised, the truthfulness or accuracy of the listings, or the ability of buyers to pay or sellers to deliver.
5.2. No Warranty: The Service and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
5.3. Limitation of Liability: To the maximum extent permitted by applicable law, Afroduca shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to your access to or use of, or inability to access or use, the Service or any content thereon, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if Afroduca has been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us, if any, for the use of the Service in the twelve (12) months preceding the claim.
6. Intellectual Property
6.1. Our Intellectual Property: The Service and its original content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software) are and will remain the exclusive property of Afroduca and its licensors. They are protected by copyright, trademark, and other laws of Ghana and international treaties. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
6.2. User Content License: By posting content on Afroduca, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Service and our business, including for promotional purposes.
7. Indemnification
You agree to indemnify, defend, and hold harmless Afroduca and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your content, your conduct in connection with the Service or with other users, or your violation of these Terms or any applicable law or the rights of any third party.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ghana.
9. Changes to These Terms
We reserve the right to modify or revise these Terms at any time without prior notice. We will post any changes on this page, and the "Last Updated" date will be updated accordingly. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any updates or changes.
